Overview

Nestor D. Galarza is a senior associate in Napoli Shkolnik’s Complex Litigation Department, who focuses his practice on obtaining the best results for clients in the areas of governmental affairs and mass tort litigation, as well as legal briefing in breach of contract, personal injury, medical malpractice, other civil matters and arbitration proceedings. He is a member of the Trial Lawyers of Puerto Rico.

Mr. Galarza is part of a team of attorneys that strive to provide the best legal representation for plaintiff cities and counties nationwide in In re National Prescription Opiate Litigation which has resulted in billions in settlements with opioid manufacturers, distributors and retail pharmacies to directly pay state and local governments impacted by the opioid crisis. He also represents multiple clients in the price fixing multidistrict litigations MDL 2724 In re Generic Pharmaceuticals Pricing Antitrust Litigation (EDPA) and the newly formed MDL 3080, In re Insulin Pricing Litigation (New Jersey). In MDL 2724, he has participated in various attorney groups handling important work for the common benefit of all plaintiffs and represented clients in hearings, special master proceedings and other conferences.

Mr. Galarza has also successfully handled motion practice, appeals and other briefing in multiple cases at the firm, including complex civil litigation matters, personal injury, medical malpractice, breach of contract, fee disputes and other civil cases. He is also a member of the firm’s trial strikeforce team.

Prior to joining Napoli Shkolnik, Mr. Galarza worked at various firms in Puerto Rico that handled  state and federal civil litigation in complex commercial cases, catastrophic losses, personal injury, medical malpractice, insurance defense litigation, insurance coverage, injunction and prejudgment attachment litigation and other civil matters in local and federal courts. This included the highly recognized defense firms Saldaña, Carvajal & Vélez-Rivé and Cobian & Cobian, PSC, as well as in-house counsel work, contract disputes, medical malpractice trial work and other civil litigation matters at one of the largest hospital systems in the Caribbean, Metro Pavia Health System. He has also handled considerable amounts of personal injury and large catastrophic loss litigations in the boutique firm Cobian Roig Law Offices and worked in other leadership and mentorship roles in the Puerto Rico Law Review bar exam preparatory programs.

$650 Million Ruling in National Pharmacy Chain Opioid Trial
U.S. District Court for Northern Ohio Judge Dan Aaron Polster ruled that CVS, Walgreens and Walmart must pay over $650 million over 15 years and set up an abatement program to Lake and Trumbull counties. The ruling is the first by a federal judge that assigns a monetary amount against pharmacy chains for their role in the opioid epidemic.

The funds will be used in programs to address the fallout from opioid abuse the defendant’s marketing of opioids caused.

The jury held Teva Pharmaceuticals USA, Inc., Cephalon, Inc., Actavis, LLC, Actavis Pharma, Inc., Watson Laboratories, Inc., and Anda, Inc. responsible for causing a public nuisance.

$1.1 Billion Settlement: New York Opioid Jury Trial
This settlement was reached with the three largest drug distributors, AmerisourceBergen, Cardinal Health and McKesson, in the first opioid jury trial.

Endo Pharmaceutical agreed to this settlement to end their involvement in the NY opioid jury trial, where the company was accused of its role in the opioid epidemic.

This landmark settlement was reached on behalf of Cuyahoga County (Ohio), one of the bellwether plaintiffs in the National Opioid Litigation, against four of the key players responsible for the opioid epidemic.
